Terms of Service
Effective date: October 17, 2026
These Terms explain the rules for using BookNestly and the responsibilities of users and the service operator.
1. Agreement to these terms
These Terms of Service ("Terms") govern your access to and use of BookNestly, an event business management application operated by The Budget Developer LLC ("BookNestly," "we," "us," or "our").
By accessing or using BookNestly, you agree to these Terms. If you use BookNestly on behalf of a business or organization, you represent that you have authority to bind that organization to these Terms.
2. The service
BookNestly is designed to help event businesses organize leads, clients, events, quotes, contracts, and related workflows. Available functionality may change as the service is developed and updated.
Some features may be in development, unavailable, or offered only to selected users. We do not guarantee that every feature will be available at all times or that BookNestly will be suitable for every business need.
3. Accounts and account security
You must provide accurate information when creating an account and keep your account information reasonably current. You are responsible for safeguarding your sign-in credentials and for activity conducted through your account, except to the extent caused by our failure to meet obligations imposed by applicable law.
Notify us promptly if you believe your account has been accessed without authorization. Do not share credentials or permit access in a way that violates these Terms.
4. Your business and customer information
You retain your rights in the information and content you submit to BookNestly, subject to the rights needed to operate the service.
You grant us permission to host, process, transmit, display, and otherwise use that content as reasonably necessary to provide, maintain, secure, and support BookNestly.
You are responsible for ensuring that you have the necessary rights, permissions, notices, and legal basis to submit and use information about your clients, leads, events, employees, and other individuals. You must not submit content unlawfully or in violation of another person's rights.
5. Acceptable use
You agree not to:
- Use BookNestly for unlawful, deceptive, or fraudulent activity.
- Attempt to gain unauthorized access to accounts, systems, or data.
- Interfere with the security, integrity, or availability of the service.
- Upload malicious code or content that infringes another person's rights.
- Reverse engineer or misuse the service except where applicable law expressly permits it.
- Use BookNestly to send unlawful communications or process information without required permissions.
6. Fees, subscriptions, and payments
If paid plans or other paid features are offered, the applicable prices, billing periods, renewal terms, and cancellation procedures will be presented before you commit to a purchase.
If BookNestly enables payment workflows for your event business, third-party payment providers may process transactions under their own terms. You may need to establish and maintain a separate account with the applicable provider and complete its verification requirements.
BookNestly does not guarantee that a payment provider will approve an account, authorize a transaction, or make funds available by a particular time. You are responsible for the terms you agree to with your payment provider and for complying with applicable payment, tax, refund, and consumer-protection obligations.
Any fees, refund rights, and cancellation terms specific to a plan or transaction will be governed by the terms shown when that purchase or transaction is made and applicable law.
7. Third-party services
BookNestly may link to or integrate with third-party services. We do not control independent third-party services and are not responsible for their content, availability, or practices. Your use of those services may be subject to separate terms and privacy policies.
8. Intellectual property
BookNestly and its associated software, branding, design, and other materials, excluding content submitted by users and third-party materials, are owned by or licensed to The Budget Developer LLC and are protected by applicable intellectual property laws.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to use the service for its intended business purposes. No other rights are granted except as required by law or expressly agreed in writing.
9. Service availability and changes
We may update, improve, suspend, or discontinue parts of BookNestly as permitted by law. We will make reasonable efforts to communicate material changes where appropriate. We are not responsible for interruptions caused by circumstances outside our reasonable control, subject to obligations imposed by applicable law.
10. Suspension and termination
You may stop using BookNestly at any time. We may suspend or terminate access if reasonably necessary to address a security risk, suspected unlawful activity, a material violation of these Terms, or a legal requirement. Where appropriate and legally permitted, we will provide notice or an opportunity to address the issue. Provisions that by their nature should continue after termination will survive.
11. Disclaimers
To the extent permitted by applicable law, BookNestly is provided on an "as is" and "as available" basis. We do not make warranties that the service will be uninterrupted, error-free, or suitable for every particular purpose. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.
12. Limitation of liability
To the extent permitted by applicable law, The Budget Developer LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, goodwill, or data, arising from your use of BookNestly. Nothing in these Terms limits liability that cannot lawfully be limited or excluded. Where a limitation is not permitted in full, it applies only to the maximum extent allowed by law.
13. Indemnification
To the extent permitted by applicable law, you are responsible for claims arising from your unlawful use of BookNestly, your violation of these Terms, or content you submit that infringes another person's rights. This section does not apply where prohibited by law.
14. Governing law
These Terms are governed by the laws of the State of Maryland, without regard to conflict-of-law principles, except where applicable law requires otherwise. Any dispute will be handled in a court with appropriate jurisdiction, subject to any mandatory rights or venue rules that apply to you.
15. Changes to these Terms
We may update these Terms as BookNestly evolves. We will post the updated version on this page and revise the effective date. Where required by law, we will provide notice of material changes. Continued use after changes take effect constitutes acceptance only to the extent permitted by applicable law.
